Important: This policy is part of our Terms of Service . Violations may result in immediate suspension or termination of your account without prior notice.

1. Purpose and Scope

This Acceptable Use Policy outlines the acceptable and prohibited uses of ModuSell's ecommerce platform. It is designed to protect our users, maintain the integrity of our platform, and ensure compliance with applicable laws and regulations.

This policy applies to all users of ModuSell, including merchants, customers, administrators, and anyone who accesses or interacts with our platform in any capacity.

This AUP is incorporated into and forms part of our Terms of Service . Violations of this policy constitute a breach of our Terms of Service and may result in enforcement actions up to and including account termination.

We reserve the right to update this policy at any time to reflect changes in legal requirements, industry standards, or platform capabilities. Material changes will be communicated through email or platform notifications.

2. Permitted Uses

ModuSell is designed to support legitimate ecommerce businesses. We welcome merchants who operate lawful businesses in the following categories:

  • Legal retail and ecommerce: Physical products, consumer goods, and merchandise that comply with applicable laws
  • Digital products and services: Software, ebooks, music, videos, templates, and digital downloads
  • Physical goods and merchandise: Apparel, accessories, home goods, electronics, and other tangible products
  • Subscription-based businesses: Recurring product deliveries, membership programs, and subscription services
  • Educational content and courses: Online courses, training programs, tutorials, and educational materials
  • Creative works and art: Original artwork, photography, handmade items, and creative products
  • Software and SaaS products: Cloud-based applications, software licenses, and technology services
  • Professional services: Consulting, coaching, design services, and other professional offerings
  • Handmade and craft items: Artisanal products, handcrafted goods, and DIY supplies

All permitted uses must comply with applicable local, state, national, and international laws, including but not limited to consumer protection laws, intellectual property laws, and regulations specific to your industry or product category.

3. Prohibited Products and Services

The following products and services are strictly prohibited on ModuSell:

3.1 Illegal Items

  • Illegal drugs, controlled substances, and drug paraphernalia
  • Stolen goods, property, or items obtained through illegal means
  • Counterfeit products, knock-offs, or replica items
  • Illegal weapons, explosives, or items designed to cause harm
  • Products made from endangered species or protected wildlife
  • Items that violate import/export regulations or sanctions

3.2 Regulated Items Without Proper Authorization

  • Prescription drugs, medications, and medical devices without proper licenses
  • Tobacco products and vaping devices without age verification and licenses
  • Alcohol and alcoholic beverages without proper permits and age verification
  • Firearms, ammunition, and weapons without appropriate licenses
  • Gambling services, lotteries, or games of chance without proper authorization

3.3 Adult Content

  • Sexually explicit material or pornographic content without proper age verification
  • Adult-oriented products without appropriate age gates and warnings
  • Escort services, prostitution, or sexual services
  • Adult content involving or appearing to involve minors

3.4 Harmful or Dangerous Items

  • Items that promote self-harm, suicide, or eating disorders
  • Dangerous chemicals, toxic substances, or hazardous materials
  • Explosives, fireworks (in jurisdictions where prohibited), or incendiary devices
  • Instructions or guides for manufacturing weapons or illegal substances
  • Items designed to circumvent security measures or facilitate illegal activities

3.5 Financial and Investment Services

  • Unlicensed financial advice, investment services, or securities trading
  • Pyramid schemes, multi-level marketing (MLM) schemes, or chain letters
  • High-risk investment schemes, penny stocks, or unregistered securities
  • Cryptocurrency trading or exchange services without proper compliance
  • Money transfer services, check cashing, or payment processing without licenses
  • Payday loans, title loans, or predatory lending services

3.6 Fraudulent or Deceptive Products

  • Get-rich-quick schemes, work-from-home scams, or unrealistic earnings claims
  • Miracle cures, unproven medical treatments, or false health claims
  • Weight loss products with misleading claims or unsubstantiated results
  • Products marketed with fake reviews, testimonials, or false endorsements
  • Items using deceptive pricing, false scarcity tactics, or bait-and-switch schemes
  • Diploma mills, fake degrees, or fraudulent certifications

3.7 Intellectual Property Violations

  • Pirated software, media, or digital content
  • Counterfeit branded goods or trademark infringement
  • Unauthorized use of copyrighted materials, images, or text
  • Products that infringe on patents or trade secrets
  • Unauthorized merchandise using celebrities' names, images, or likenesses

3.8 Other Prohibited Items

  • Items that promote hate, violence, or discrimination against protected groups
  • Items that sexualize, endanger, or exploit children
  • Hacking tools, malware, viruses, or services designed to compromise security
  • Academic dishonesty services (essay mills, exam answers, plagiarism tools)
  • Fake documents, forged credentials, or identity theft services
  • Spam email lists, personal data harvesting, or privacy-violating tools
  • Items that facilitate illegal surveillance or invasion of privacy

WARNING: Engaging in the sale of prohibited items will result in immediate account termination. ModuSell reserves the right to report illegal activities to law enforcement authorities and cooperate fully with any investigations.

4. Prohibited Activities

The following activities are strictly prohibited when using ModuSell:

4.1 Fraudulent Activities

  • Providing false, misleading, or deceptive information to customers or ModuSell
  • Phishing, scamming, or attempting to defraud users or customers
  • Identity theft, impersonation, or unauthorized use of others' credentials
  • Payment fraud, credit card fraud, or chargeback abuse
  • Intentional chargeback fraud or filing false disputes
  • Tax evasion, money laundering, or other financial crimes

4.2 Abuse and Harassment

  • Harassing, threatening, or abusing customers, users, or ModuSell staff
  • Bullying, intimidation, or creating a hostile environment
  • Hate speech, discriminatory content, or targeted harassment based on protected characteristics
  • Stalking, doxxing, or publishing private information without consent
  • Threats of violence, harm, or retaliation

4.3 Spam and Unsolicited Communications

  • Sending spam emails, unsolicited bulk messages, or marketing communications
  • Using purchased or scraped email lists without proper consent
  • Violating the CAN-SPAM Act or other anti-spam regulations
  • Excessive or unwanted contact with customers who have opted out
  • Automated messaging or bot communications without disclosure

4.4 Platform Manipulation

  • Creating multiple accounts to evade restrictions, bans, or suspensions
  • Manipulating votes, ratings, reviews, or rankings
  • Creating fake accounts, bots, or automated systems to generate false activity
  • Impersonating other users, brands, or organizations
  • Gaming or exploiting platform algorithms, ranking systems, or recommendation engines
  • Engaging in review manipulation, fake testimonials, or artificial social proof

4.5 Security Violations

  • Attempting to hack, breach, or gain unauthorized access to ModuSell systems
  • Distributing malware, viruses, trojans, or other malicious code
  • Conducting denial-of-service (DoS or DDoS) attacks against ModuSell or other users
  • Exploiting security vulnerabilities without proper disclosure through our responsible disclosure policy
  • Attempting to intercept, decrypt, or access data you are not authorized to access
  • Phishing for credentials or attempting to compromise user accounts

4.6 Terms Circumvention

  • Attempting to bypass or circumvent platform fees or payment processing
  • Conducting transactions off-platform to avoid fees or monitoring
  • Misrepresenting your business type, location, or product category
  • Providing false information during account registration or verification
  • Using technical measures to circumvent usage limits or restrictions

Warning: Attempting to circumvent platform fees or policies may result in account suspension, collection of owed fees plus penalties, and potential legal action for breach of contract.

5. Content Guidelines

5.1 Product Descriptions

All product descriptions must be:

  • Accurate: Truthfully represent the product's features, specifications, and condition
  • Not misleading: Avoid exaggerations, false claims, or deceptive marketing tactics
  • Complete: Include all material information customers need to make informed decisions
  • Compliant: Follow advertising laws, including FTC guidelines and consumer protection regulations
  • Free of false health claims: Do not make unsubstantiated medical or health claims

5.2 Images and Media

Product images and media must:

  • Not contain explicit, violent, or inappropriate content (unless properly gated for adult audiences)
  • Not infringe on copyright, trademarks, or other intellectual property rights
  • Be relevant and accurately represent the product being sold
  • Not be misleading or use deceptive photography techniques
  • Not contain hidden malicious code, tracking pixels, or privacy-violating elements

5.3 User-Generated Content

You are responsible for all content that appears on your store, including:

  • Customer reviews and comments posted on your store
  • Forum posts, discussion boards, or community content
  • User-submitted images, videos, or other media
  • Blog posts, articles, or editorial content

Important: You are responsible for moderating user-generated content on your store. Failure to remove inappropriate content when notified may result in policy violations attributed to your account.

5.4 Branding and Trademarks

  • Do not use others' trademarks, logos, or brand names without authorization
  • Do not impersonate brands, companies, or individuals
  • Do not create confusion about your affiliation with or endorsement by third parties
  • Follow fair use guidelines when referencing brands in comparative advertising

6. Technical Use Restrictions

6.1 Resource Usage

You must use platform resources fairly and reasonably:

  • Bandwidth: Do not exceed reasonable bandwidth limits or engage in bandwidth abuse
  • Storage: Respect storage limitations for your plan tier
  • API rate limits: Stay within API call limits and do not attempt to circumvent rate limiting
  • Processing resources: Do not run resource-intensive processes that degrade platform performance
  • Fair use: Use resources proportionally to your business needs without monopolizing shared resources

6.2 Automation and Bots

  • Do not use automated scraping tools to extract platform data without authorization
  • API usage must follow our API terms of use and rate limits
  • Do not deploy unauthorized bots, crawlers, or automated scripts
  • Do not create automated account registration or bulk account creation systems

6.3 Security Testing

Unauthorized security testing, penetration testing, or vulnerability scanning is prohibited. If you discover a security vulnerability:

  • Report it immediately through our responsible disclosure policy
  • Do not exploit the vulnerability or access unauthorized data
  • Do not publicly disclose the vulnerability before we have addressed it

6.4 Reverse Engineering

  • Do not reverse engineer, decompile, or disassemble any part of the ModuSell platform
  • Do not attempt to derive source code, algorithms, or trade secrets from our services
  • Do not circumvent security measures, encryption, or access controls

6.5 System Interference

  • Do not engage in activities that disrupt, degrade, or impair platform service
  • Do not interfere with other users' access to or enjoyment of the platform
  • Do not overload systems or networks through excessive requests
  • Do not introduce viruses, malware, or malicious code into our systems

7. User Responsibilities

As a ModuSell user, you are responsible for:

  • Legal compliance: Complying with all applicable local, state, national, and international laws
  • Licenses and permits: Obtaining all necessary business licenses, permits, and authorizations
  • Accurate information: Maintaining accurate and up-to-date business and contact information
  • Customer commitments: Honoring all commitments, warranties, and guarantees made to customers
  • Customer support: Providing responsive and helpful customer service
  • Refunds and returns: Handling refunds, returns, and disputes fairly and in accordance with your stated policies
  • Data protection: Protecting customer data and complying with GDPR, CCPA, and other privacy regulations
  • Your policies: Maintaining your own terms of service, privacy policy, and other required legal documents
  • Security: Keeping your account credentials confidential and secure
  • Incident reporting: Reporting security incidents, data breaches, or policy violations promptly
  • Payment information: Keeping payment information current and valid
  • Fee payment: Paying all fees when due without attempting to circumvent payment
  • Communication: Responding to communications from ModuSell in a timely manner

8. Monitoring and Enforcement

8.1 Our Rights

ModuSell reserves the right to:

  • Monitor compliance with this Acceptable Use Policy and our Terms of Service
  • Investigate suspected violations and request additional information from users
  • Remove content that violates this policy or our Terms of Service
  • Suspend or restrict access to accounts pending investigation
  • Terminate accounts for policy violations
  • Report illegal activities to law enforcement authorities
  • Cooperate with legal investigations and comply with legal process

We are not obligated to monitor all user activity but may do so at our discretion.

8.2 Investigation Process

When investigating potential violations:

  • We may request information, documentation, or clarification about your business or activities
  • You are required to cooperate fully with investigations and provide requested information
  • Failure to respond within the specified timeframe (typically 3-5 business days) may result in account suspension
  • We will make reasonable efforts to communicate with you before taking enforcement actions, except in cases of serious violations

8.3 Enforcement Actions

Enforcement actions may include:

  • Warning: Written notice of policy violation with instructions to remedy
  • Temporary suspension: Temporary restriction of account access pending investigation or remediation
  • Permanent termination: Permanent closure of account for serious or repeated violations
  • Withholding of funds: Temporary hold on payouts pending investigation or resolution
  • Legal action: Civil or criminal legal proceedings for violations causing harm or damages
  • Law enforcement referral: Reporting of illegal activities to appropriate authorities

The severity of enforcement action depends on the nature, severity, and frequency of violations.

8.4 Appeals Process

If your account is suspended or terminated, you may appeal the decision:

  • Timeframe: Appeals must be submitted within 30 days of the enforcement action

  • Information to include: Your account information, explanation of circumstances, evidence supporting your appeal, and proposed remediation
  • Review: We will review your appeal within 14 business days and notify you of our decision
  • Final decision: Appeal decisions are final and made at ModuSell's sole discretion

8.5 Repeat Violations

Repeated violations of this policy will result in escalating consequences:

  • First violation: Warning with required remediation
  • Second violation: Temporary suspension (7-30 days)
  • Third violation: Extended suspension or permanent termination
  • Pattern of violations: Immediate permanent termination without appeal

Critical: We reserve the right to immediately terminate accounts for serious violations including illegal activities, fraud, or activities that pose security risks without prior warning or appeal opportunity.

9. Reporting Violations

We encourage users to report violations of this Acceptable Use Policy. Your reports help maintain a safe, trustworthy platform for everyone.

Confidentiality: We treat all reports confidentially and protect reporter identities to the extent permitted by law.

No retaliation: We prohibit retaliation against users who report policy violations in good faith.

Anonymous reporting: You may submit anonymous reports, though providing contact information helps us follow up if we need clarification.

False reports: Submitting intentionally false or malicious reports may result in action against your account.

Response timeframe: We take all reports seriously and will investigate within 48 hours. However, we cannot always disclose investigation outcomes due to privacy considerations. We will notify you if we need additional information.
